TasteTrade respects the intellectual property rights of others and expects users to do the same. This page outlines our procedures for handling copyright infringement claims under the Digital Millennium Copyright Act (DMCA).

1. Overview

TasteTrade, Inc. ("TasteTrade," "we," or "us") operates the TasteTrade platform and is committed to complying with the Digital Millennium Copyright Act of 1998 ("DMCA"). We will respond expeditiously to claims of copyright infringement committed using our service that are properly reported to our Designated Copyright Agent.

If you believe that your copyrighted work has been copied and is accessible on TasteTrade in a way that constitutes copyright infringement, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing.

2. Filing a DMCA Takedown Notice

To file a valid DMCA takedown notice pursuant to 17 U.S.C. 512(c)(3), you must provide the following information:

Required Information:

1Physical or electronic signature of the copyright owner or a person authorized to act on their behalf
2Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works
3Identification of the material that is claimed to be infringing and where it is located on TasteTrade (provide the specific URL(s))
4Your contact information including your name, address, telephone number, and email address
5A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
6A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Important Notice

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Please ensure your claim is valid before submitting.

3. Counter-Notification Process

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent with the following information:

Counter-Notification Requirements:

1Your physical or electronic signature
2Identification of the material that has been removed and the location where it appeared before removal
3A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
4Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and will accept service of process from the person who provided the original DMCA notification

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If the original complaining party does not file a court action within 10-14 business days, we may restore the removed content.

4. Repeat Infringer Policy

TasteTrade maintains a policy of terminating, in appropriate circumstances, subscribers and account holders who are repeat infringers. If a user is found to have repeatedly infringed upon the copyrights of others, TasteTrade may:

•Issue warnings to the user
•Temporarily suspend the user's account
•Permanently terminate the user's account
•Remove all content uploaded by the user from the platform
